Terms of Use

Open Research Europe ("ORE" or the "Platform") is an open access publishing platform for research funded by the European Commission together with national funders and research organisations (the "ORE Funders").

The Platform is provided and operated on behalf of the ORE Funders by the European Organization for Nuclear Research ("CERN"). By virtue of its international legal status, CERN enjoys certain privileges and immunities in its Member States. Nothing in these Terms of Use (including any reference to external rules) shall constitute or be construed as a waiver by CERN of its privileges and immunities.

Any use of the Platform is subject to these Terms of Use, as amended from time to time (the "Terms of Use").

All individuals accessing and making use of the Platform shall be referred to herein as "Users".

  1. By using the Platform, Users confirm to accept and agree to be bound by the Terms of Use.
  2. Any use of the Platform shall at all times be subject to these Terms of Use, but certain parts and uses of the Platform may also be subject to the editorial policies of ORE or other specific policies (the "Additional Terms").
  3. Users may use the Platform for lawful and non-military purposes only. Users must not use the Platform in any unlawful way or in a way that breaches any applicable laws. This applies to Users' use of the Platform and any content or material that they may contribute to the Platform.
  4. CERN reserves the right to change any of these Terms of Use or the Additional Terms at any time by posting changes on the Platform and Users will be deemed to have accepted such changes if they use the Platform after CERN has published the updated version.
  5. The platform contains (a) content that is the property of the European Commission (“Open Research Europe Content”), (b) content licensed to Open Research Europe and (c) content made available under a Creative Commons license (“OA Content”, short for “open access content”). The copyright in the OA Content belongs to the licensors thereof. The trademarks appearing on the Platform are protected by applicable national and international trademark laws. The OA Content may be used in accordance with the terms of the applicable Creative Commons license by which it is made available.
  6. Users uploading their content to the Platform shall be exclusively responsible for the content that they upload and shall indemnify and hold CERN free and harmless in connection with their use of the Platform. Users uploading its OA content shall ensure that their content is suitable for open dissemination, and that it complies with these Terms of Use and any applicable laws, including, but not limited to, privacy, data protection and intellectual property rights. In addition, where data that was originally sensitive personal data is being uploaded for open dissemination through the Platform, the uploader shall ensure that such data is either anonymised to an appropriate degree or fully consent cleared. CERN shall have no obligation to monitor or enforce compliance with the above requirements, nor to investigate or follow up on any related complaints.
  7. Hosting and making content available through the Platform do not represent any approval or endorsement of such content by CERN, the European Commission, or the ORE Funders.
  8. Save as expressly set out herein no licence or rights are granted to Users in respect of any intellectual property rights vested in the European Commission, CERN, the ORE Funders or any third parties. The download and use of any information from the Platform shall not amount to a transfer of intellectual property in any case whatsoever.
  9. All personal data will be processed in accordance with the Open Research Europe Privacy Notice.
  10. CERN reserves the right, without notice, at its sole discretion and without liability, (i) to alter, delete or block access to content that it deems to be inappropriate or insufficiently protected, and (ii) to suspend, restrict or terminate User access where it considers that the use of the Platform interferes with its operations or violates these Terms of Use, the Additional Terms, or applicable laws.
  11. Users may not redistribute any of the content of the Platform or create a database in electronic form or manually by downloading and storing any such content, unless licensed to do so by the applicable OA Content Creative Commons license, without the prior written authorization of CERN.
  12. The Platform and its content are provided for use 'as is'. CERN makes no representations or warranties with respect to the Platform or its content. Any warranty, express or implied, including without limitation any implied warranty of merchantability, satisfactory quality and fitness for purpose relating to the Platform and/or its content and/or any website to which it is linked is excluded to the fullest extent permitted by law. No representations or warranties are given as to the accuracy or completeness of the information provided on the Platform, its content or any website to which it is linked.
  13. CERN does not guarantee that the Platform or any of its content will always be available or be uninterrupted, or that it will be secure or free from bugs or viruses. CERN may suspend or withdraw or restrict the availability of all or any part of the Platform or its content at any time for business and/or operational reasons and will use reasonable endeavours to provide notice of any suspension or withdrawal to Users.
  14. Users are responsible for configuring their information technology, computer programmes and/or platform to access the Platform, the content and the linked websites, and as such, Users should use and rely on their own virus protection software. Users must not misuse the Platform by knowingly introducing viruses or other material that is malicious or technologically harmful, and must not attempt to gain unauthorised access to the Platform, the server on which the Platform is stored, or any server, computer or database connected to the Platform.
  15. To the extent permittable by law, and except in case of wilful misconduct and gross negligence, CERN, its members of personnel, affiliates, agents, suppliers, or contractors shall not be liable for any damages of any nature including, without limitation, any consequential loss, loss of income or profit, loss of or damage to property, claims of third parties, or any other loss, cost, claim or expense of any kind or character arising out of or in connection with Users' use of the Platform, its content or any website with which it is linked, as well as out of or in connection with the suspension, restriction, limitation or termination of Users' access to the Platform for any reason, or blocking or deletion of any content.
  16. Users shall not assign or transfer any of their rights and obligations under these Terms of Use or any of the Additional Terms.
  17. If Users link to the Platform, they can only do so in a way that is fair and legal and does not damage CERN's reputation or take advantage of it in any way, as decided by CERN in its sole discretion. CERN reserves the right to withdraw linking permission for any reason and without notice.
  18. Users hereby agree to indemnify and hold free and harmless CERN, its members of personnel, affiliates, agents, suppliers, and contractors from and against any and all losses (including without limitation direct, indirect and consequential loss), costs, claims, damages or expenses of whatever nature and howsoever caused arising directly or indirectly from Users' use of the Platform or any breach of these Terms of Use or any Additional Terms or applicable laws.
